These Terms & Conditions ("Terms") govern the provision of services by Care Property Management, located at Nikou Kazatzaki 3, 7101 Aradippou, Larnaca, Cyprus ("the Company", "we", "us").

By signing a Service Agreement or explicitly engaging our services, the Client ("you") agrees to be bound by these Terms.

1. Scope of Services

Care Property Management provides administration services strictly for the Common Areas of Buildings ("Koinoxrista"). Services are provided exclusively within the district of Larnaca, Cyprus to:

  • Building Management Committees.
  • Authorized representatives acting on behalf of the building's common interest.

Exclusion of Private Units: The Company does not provide management, maintenance, or rental services for individual private apartments or units. Our scope is strictly limited to the communal parts of the building.

Non-Exclusivity: The Client acknowledges that the Company provides similar services to other buildings. Nothing in this Agreement shall prevent the Company from providing services to other clients, even if they are located in the same neighborhood.

2. Nature of Services (Coordinator Role)

The Company acts strictly as a coordinator and administrator for the Common Areas. Our duties typically include:

  • Collection of common expenses and financial reporting for the building.
  • Administrative supervision of common areas (entrance, stairs, elevators, etc.).
  • Sourcing and coordinating third-party technicians for communal repairs.

Important: The Company is NOT a construction contractor, technical engineer, or legal advisor. We manage the administration process, not the technical execution.

3. Third-Party Liability

Technical works (plumbing, electrical, elevator maintenance, cleaning, etc.) are performed by independent third-party professionals.

  • No Vicarious Liability: The Company is not liable for the negligence, delays, poor workmanship, or omissions of third-party contractors.
  • Direct Relationship: The contractual relationship regarding the technical quality of the work effectively lies between the Building Committee and the third-party contractor.

4. Payments & Suspension

Fees are defined in the signed Service Agreement.

  • Non-Refundable: Management fees paid are non-refundable, except where the Company is in proven material breach of the agreement.
  • Late Payments: The Company reserves the right to charge statutory interest on overdue common expense balances as permitted by Cyprus Law.
  • Suspension: We reserve the right to suspend services if the building's financial obligations are not met.

Availability of Funds: The Company’s obligation to pay third-party vendors (e.g., EAC, Water Board, Cleaners) is strictly conditional upon the existence of sufficient funds in the Building's designated bank account. The Company is under no circumstances obliged to advance its own funds to cover building expenses.

5. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of Cyprus:

  • The Company shall not be liable for damages occurring within private units (apartments).
  • The Company is not liable for damages caused by "Force Majeure" events (e.g., earthquakes, pandemics, extreme weather).

6. Indemnification

The Management Committee (and by extension the Building Owners) agrees to indemnify, defend, and hold the Company harmless from any claims, damages, liabilities, or legal costs arising from:

  • Actions taken by the Company strictly in accordance with the Committee's instructions.
  • The lack of sufficient funds in the Building's account which results in service disruption.
  • Existing structural defects of the building known or unknown to the Company.

7. Changes to Terms

We reserve the right to update these Terms at any time. Significant changes will be communicated via email or a prominent notice on our website. Continued use of our services after such changes constitutes acceptance of the new Terms.

8. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Larnaca.
